The Kansas Bureau of Investigation is investigating an incident involving Hamilton County Sheriff Richard Garza that occurred early Sunday morning.

Hamilton County Attorney Rob Gale requested a special prosecutor, and Scott City Attorney John Shirley has been appointed to handle the case, according to a press release issued by the KBI.

Details are scarce, but Shirley told The Associated Press the incident involving Garza was a "family matter" and that there was no physical violence.

The Hamilton County Sheriff’s Office referred questions to Gale’s office. Gale did not return phone messages seeking comment. According to the KBI, any additional information regarding possible charges will be issued by Shirley.

Shirley said that because the KBI is investigating the incident, he cannot provide any details about the case until charges are filed. Shirley, who confirmed it was a criminal investigation, said he doesn’t anticipate charges will be filed for a couple of weeks.
