The state Court of Appeals has been asked to
strike down an air-quality permit for a new coal-fired power plant
in southwest Kansas.
The request was filed by the Sierra Club yesterday in Topeka. It
asks the court to set aside the permit issued last month by the
Kansas Department of Health and Environment to Sunflower Electric
Power Corp.
The Hays-based utility plans to build the new power generator at
its plant near Holcomb, in Finney County .
Sierra Club attorneys want the court to issue an injunction
stopping Sunflower from building the generator until another permit
can be issued.
The group argues in part that flawed environmental data were
used in the permitting process.
