Smoking Ban Challenged

A judge has ruled that a statewide smoking

ban is legal.

The decision was handed down Tuesday by Sedgwick County Judge

Jeffrey Goering in a lawsuit filed by Wichita business owners. The

business owners wanted to follow the less restrictive city

ordinance rather than the state law.

Attorney General Steve Six called the ruling another victory for

public health in Kansas.

Six said in a written statement that the proper forum for their

concerns is with the Legislature and not the court system.
